Ryan’s Mastermind Dinner (the “Event”) is sponsored by Serhant Media Group LLC (“Serhant,” “we,” “us,” or “our”). By purchasing a ticket to the Event, you hereby agree to the following terms and conditions (the “Terms”). These Terms contain a waiver and release of liability by you, and constitute a binding, legal agreement between you and Serhant. Please read them.
Eligibility: You must be a graduate of the Sell it Like Serhant course and 21 years or older to purchase a ticket to the Event. You are responsible for your own transportation and lodging. The ticket you have purchased is exclusively for attendance at the Event.
Assumption of Risk: You hereby assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with your attendance at the Event. You hereby accept full responsibility for any liability, injury, loss, damage, or death caused, directly or indirectly, by your acts or omissions at or concerning the Event. It is your responsibility to notify us of any food allergies or aversions. You are solely liable for your consumption of alcoholic beverages at the event. You hereby agree to drink responsibly and at all times be respectful of your host, fellow guests, and the venue.
No Warranties; Limitation of Liability: THE EVENT SHALL BE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. SERHANT HEREBY DISCLAIMS ALL WARRANTIES. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SERHANT IS NOT RESPONSIBLE FOR THE FOOD OR BEVERAGE SERVED OR CONSUMED AT THE EVENT. YOUR ATTENDANCE AND CONSUMPTION AT THE EVENT ARE AT YOUR OWN RISK.
IN ADDITION, ALL INFORMATION, DISCUSSION TOPICS, TIPS, AND OTHER CONTENT DISCUSSED OR DISCLOSED BY SERHANT AT THE EVENT (COLLECTIVELY, “CONTENT”) ARE FOR INFORMATIONAL PURPOSES ONLY. WE MAKE NO REPRESENTATION OR WARRANTY REGARDING ANY SUCH CONTENT, AND YOUR USE THEREOF OR RELIANCE THEREON IS AT YOUR OWN RISK.
WE ARE NOT LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSSES OR DAMAGES IN CONNECTION WITH THE EVENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILTY THEREOF. YOU FURTHER ACKNOWLEDGE THAT WE ARE IN NO WAY LIABLE FOR ANY INJURY TO YOU OR ANY THIRD PARTY RESULTING FROM YOUR OWN CONDUCT OR BEHAVIOR, OR THAT OF OTHER GUESTS. ANY LIABILITY FOUND ON THE PART OF SERHANT SHALL BE LIMITED TO THE COST OF YOUR TICKET. NOTHING IN THESE TERMS SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.
Photographs and Recordings: We reserve the right to take photographs or other audio and/or visual recordings of the Event (“Recordings”). You hereby grant Serhant, our agents, successors, assigns, and those acting with our authority, the unrestricted right to record and use your name, image, likeness, and/or voice (the “Material”), in whole or in part, in any manner and any media, including advertising, promotions, and any other commercial use. We shall be the sole owner of all Recordings and intellectual property rights therein. You acknowledge that you shall not be entitled to any compensation by us and that your attendance at the Event shall be your sole consideration for permitting us to make the Recordings and use the Material. We have no obligation to use the Material.
Release of Claims: To the fullest extent permitted by law, you hereby unconditionally and forever release, indemnify, and hold harmless Serhant, our officers, directors, employees, agents, licensees, and assigns (“Serhant Parties”) from any and all liability, claims, or actions that arise from your participation in the Event or our use of the Material. This release shall be inclusive of, but not limited to, any injury or death resulting from consumption/exposure to food or beverage allergies, food borne illnesses, theft of or damage to personal property, transportation or commute, exposure to adverse weather conditions, alcohol-related injury, or choking. You agree not to sue or bring any proceeding against Serhant Parties for any claim or cause of action, whether presently known or unknown, in connection with the Event or our use of the Material.
Privacy: By purchasing a ticket, you agree to be added to our mailing list and receive promotional and other emails from us. Our promotional emails will always provide you with an opportunity to opt out of receiving future promotional emails. Any and all personal information we collect about you through your purchase of a ticket to the Event shall be used, stored, and processed in accordance with our privacy policy located at https://ryanserhant.com/privacy-policy/ (“Privacy Policy”).
Cancellation and Refunds: Your ticket is non-transferable, and non-refundable absent extenuating circumstances as determined by us in our sole discretion. We reserve the right to cancel or postpone the Event for any reason beyond our reasonable control without liability to you, including, without limitation, for acts of God, acts of any governmental body, weather, illness, or strike or other labor disturbance.
Additional Terms: In addition to these Terms, your use of our website is subject to our Terms of Use located at https://ryanserhant.com/terms-of-use/ (“Terms of Use”). The Terms of Use, along with our Privacy Policy are hereby incorporated into and made a part of these Terms. These Terms shall be governed by and construed in accordance with the laws of the State of New York, and jurisdiction shall be exclusively in the state and Federal courts of the State of New York.
